Xyience, Incorporated went bankrupt more than three years ago. I was sued by the company prior to bankruptcy, but my case and counterclaims were dragged into those proceedings. This Thursday at 9:30 AM there are two crucial hearings in the case. I will be there for the first time personally to speak to the presiding judge: Mike K. Nakagawa. These hearings are one for summary judgment in which I am seeking $175,000 for defamation and another hearing requesting to amend a $150 million sanctions motion I’ve already amended once and waited more than a year for a ruling on.

I have worked nearly four hard years on this case proclaiming my innocence of the initial defamation charges against me and championing the cause of the 385 burned shareholders shut out by the company’s bankruptcy. This is despite the main owners of the company going into and now on the other side of bankruptcy being Fertitta Enterprises, run by the same Fertitta family that just bought back their own casinos out of BK for hundreds of millions paid on over 6 billion in debt.

I will be going to Las Vegas to show how dedicated I am to finding the truth and pursuing justice, and I will also be taking the time to meet personally with some local shareholders. This case made me into a lawyer when all I wanted to be was a journalist. The effort led to a true transformation in my life, and I am now balancing two other huge legal cases involving another subject I’m writing about. I’ve appealed to the 7th Circuit 4 times with three of those cases still pending. I will appeal to the 9th Circuit if I have to in the current case.
